In this module we explored crimes against people, including various degrees of homicide, battery, domestic violence, and sexual assault. In this assignment, you will apply sexual assault laws to a real world scenario and then consider what types of interview questions you would ask the victim.
NOTE: This is a two-part assignment.
Part 1: Examine the Type(s) of Crime Committed
In this part of the assignment, you will read a scenario and write a short paper addressing questions about the scenario.
Scenario:
Jackie, 30 years old, calls 911 and reports that she just discovered to have been sexually assaulted by her husband, Timothy, 31 years old, on the night of a holiday party a couple months earlier. Jackie found a video recording on Timothy’s smart phone of him having sexual intercourse and/or contact with her while she was unconscious. Jackie has no recollection of the incident and believes that she had been drugged by Timothy. The first responding officer told Jackie that this wasn’t a crime and didn’t take a report or collect the video evidence. Jackie complained to a supervisor and you have been ordered to meet with Jackie, take a statement from her, and collect the video evidence.
To complete this part of the assignment, address the following in a minimum of two (2) pages (not counting the references page):
List the elements of the offense(s) and explain how they have been met.
Explain what type of crime(s) has/have been committed. Be sure to explain why the initial responding officer mishandled the case the first time.
If you used your textbook or outside sources to research the elements of the offense(s), include a references page following APA citation and format requirements. Be sure to cite these sources.
Part 2: Conduct the Interview
In this part of the assignment, you will consider what types of interview questions you would ask the victim to determine which criminal law has been violated.
Scenario:
You are now meeting with Jackie at her residence and you must interview her in order to obtain a written statement. Her husband, Timothy, isn’t present and has not returned home since Jackie discovered what happened. During the interview, it’s important that you ask her detailed and sensitive questions about what happened in order to determine what criminal elements have been met.
To complete this part of the assignment, address the following in a minimum of one page:
Explain how you will approach the interview with Jackie.
What sensitive questions will you ask in order to determine the nature of the assault that happened?
