The purpose of this assignment is to research and evaluate Charter cases by applying your knowledge of
the courts and constitution.
Select one of the following Charter cases:
-Sauvé v. Canada (2002) (prisoner voting)
-R. v. Keegstra (hate speech)
-Carter v. Canada (assisted dying)
-Multani v. Commission scolaire Marguerite-Bourgeoys (religion)
-Eldridge v. British Columbia (disability)
-Vriend v. Alberta (sexual orientation)
-Symes v. Canada (gender discrimination)
Download and read the case from Canada Supreme Court Reports (https://scc-csc.lexum.com/scc-csc/en/nav.do).
In a 4-5-page report, answer the following questions as it relates to the case that you have chosen:
1. What are the facts of the case?
2. What section(s) of the Charter is being challenged?
3. What is the major dispute or conflict that the court is being asked to settle?
4. Briefly describe the Oakes Test. How was the Oakes Test applied in the case?
5. What was the outcome? Be sure to discuss majority and dissenting opinions, where relevant.
6. Why is the case important to Canadian politics and society?
You are required to use outside sources to support your analysis. Scholarly sources should be used;
media coverage of the case may also be useful. Online encyclopedias and other online sources are not
considered scholarly and should be used sparingly. You should demonstrate your knowledge of the case
by making specific reference to the text of the case in your brief and using your outside sources to
support the points made. You should use an accepted method of citation such as APA. Use headers to organize your paper. This will ensure that you include all of the subsections and strengthen the organization of the paper.
