The equal rights amendment is the historical event that I have chosen. This amendment is vital to many and mostly the women since it ensures there is no discrimination against gender in the workplace. Furthermore, Equal Rights Amendment (ERA) is one of the most vital amendments to the United States’ Constitution designed ostensibly to ensure equality amongst America’s citizens. Americans were to have equal legal rights irrespective of their sexes. According to Barnett (2019), ERA was initially proposed in 1923. The proponent of this Amendment that sought to ensure the end of legal distinctions between sexes in issues relating to divorce and property ownership, employment, amongst others, was Alice Paul. The Amendment elicited controversy, and one of the notable opponents of the Amendment was Phyllis Schlafly.
The opposers of the Amendment pegged their argument that giving both sexes equal rights was against their culture. They argued that if the Amendment was passed, women were destined to lose their femininity and privileges presented by marriage. They argued that equality for all sexes would collapse society’s morality, which is an important social fabric. The opponents of ERA argued that passing this Amendment was tantamount to attacking the family as women would lose their child support, and they would go to war. These arguments came from Schlafly, one of the women who ought to have agitated for women’s suffrage, hence wading ERA’s support (Francis,2015). The opposers argued that ERA would allow for same-sex marriages and religious conservatives devotedly opposed this Amendment. Critics of this Amendment also argued that laws should not be passed to protect men and women differently.
ERA today has not been ratified to be part of the American Constitution. The need to explicitly prohibit discrimination based on sex can only be achieved after ERA has been integrated into the Constitution. The amount of power and money it takes to start a movement. However, the legal challenge that requires at least three-fourths of all the states in the US to ratify the Amendment has failed this effort. Currently, only 38 states have ratified the Amendment meaning the future of this crucial Amendment remains uncertain (White, 2019). The ratification of this Amendment would boost women’s protection against gender-based violence, discrimination at places of work and ensure that they have access to reproductive health.
The same controversies the bedeviled ERA in the past are still there today. Some of the past controversies, such as same-sex marriages that are believed to be propagated by ERA, are still contentious issues today. Americans believe in the family, and it is a value that almost all belief in. Arguments by the opposers of ERA that it would erode family values have elicited reactions from the opposers of ERA. This has made States be reluctant to pass this Amendment to the Constitution hence hindering the passage of ERA. Right to abortion continues to be a pertinent issue to date, and conservatives have vehemently opposed ERA both in the past and present due to this issue.
According to White (2019), prior to ERA, women did not have rights that are inherent to them by virtue of being humans. They were not allowed to vote, and equal pay at work places was a mirage. However, the increased campaigns against discrimination of women ushered in a new wave. ERA proponents enlightened the Authorities on the need to respect women’s rights, and they became a center of discussion. ERA played a crucial role in ensuring that women were treated equally.
Women in America still face challenges, and an example is the weakening of Title IX by the Trump administration hence jeopardizing the effort of sexual survivors to seek justice.
The equal pay Act has loopholes that employers have exploited to deny women equal pay at workplaces, hence the need to ratify ERA as a remedy to these discriminations. In reproductive health, pregnant women’s right to have light duties at work, which would enable them to continue working as they fend for their families, can be buttressed through effective ERA implementation (White,2019).

Concisely, ERA should be implemented to ensure that loopholes are sealed, and discrimination based on sex is explicitly and comprehensively dealt with. This is because “sex” or “women” is not mentioned anywhere in the American Constitution, and this Amendment will address this issue once and for all. Another reason why ERA has been fervently opposed by some quarters is that it could require the government to fund abortion, which is argued to affect reproductive justice in society. The Violence Against Women Act was passed by the House of Representatives and has significantly contributed to the reduction in Gender-based violence, and it is important that Era is passed to bolster the efforts of this act. However, respect for the rights of women has improved as they are allowed to vote, work, and get equal pay, access to reproductive health has also improved amongst others.
