The paper must contain a minimum of 750 words and must follow the formatting guidelines provided on the handout “Research Paper Guidelines”.
For this assignment, you should research the law and its purpose and then write a report in which you identify and explain the law in detail, state the purpose of the law, describe how the law applies to the hospitality industry, and describe any beneficial or adverse effects the law may have on the industry. Discuss ambiguities, conflicts, or controversies surrounding the law if there are any. Provide examples when explaining how the law applies to the industry. The paper should include a brief introduction, a body that includes the items listed above, and a summary conclusion. If you chose do research a legal topic instead of a statute or regulation, you will follow the same format as above. You just will not have to use a statute or regulation. This research paper requires analysis, not just description. You should learn about the law through research, analyze the law, and then inform the reader. To analyze means to break a topic or concept down into its parts to inspect and understand it, and to restructure those parts in a way that makes sense to you. Primary sources are original documents or research, including speeches, letters, interviews, official records, creative works, and artifacts. If writing about a poem, the text of the poem is considered a primary source. In this case, the text of the law itself, as published by the government, is a primary source. Secondary sources include interpretations or analysis of primary sources and are removed from the event or topic. Examples of secondary sources include textbooks, criticisms and newspaper or magazine articles. You should have at least one primary source in this paper, which is the statute, regulation, or pending legislation from its original source (i.e., the U.S. Code, Federal Regulations, etc.). You should have at least two other sources, whether primary or secondary. Use APA style when citing to your sources. You should think critically, not only about the subject, but also about the sources you find. Analyze your sources by evaluating their authority, credibility, accuracy, and objectivity. Remember that just because something is in print or on the Internet, it is not necessarily “the truth.” Background As we learned in Session 1 (Discussion Post 2 and Chapter Two of the textbook), the hospitality industry is subject to numerous federal, state, and local government laws and regulations. Statutes are laws written and enacted by the legislative branch of government, whether federal or state. Laws are the products of written statutes, passed by either the U.S. Congress or state legislatures. The legislatures create bills that, when passed by a vote and signed by the President or governor as the case may be, become statutory law. A bill that has been introduced to the legislature, but not yet passed, is pending legislation. Statutes are published in various “codes.” A code arranges the statutes by topic (rather than chronologically), indexes statutes to allow for subject access, and incorporates any amendments and repealed language to always give you the current picture of the law. Federal statutes are found in the United States Code, which is divided topically into Titles, Subtitles, Chapter, etc. You may see a statue referred to by a specific name, such as the Civil Rights Act of 1964, or the location in the code, such as Chapter 21 of Title 42 of the U.S. Code or 42 U.S. Code Chapter 21. Texas statutes are published in topical codes, such as the Texas Labor Code. As an example, Congress passed the Securities and Exchange Act of 1934 in an effort to curb securities fraud and insider trading after the stock market crash of 1929. The Act is codified in the United States Code as Title 15, Section 78a, and, among other things, prohibits the disclosure of false or misleading information related to securities transactions. The Securities and Exchange Act also created the Securities and Exchange Commission (SEC), tasked with enforcing federal securities laws. Regulations, on the other hand, are standards and rules adopted by administrative agencies that govern how laws will be enforced. So, an agency like the SEC can have its own regulations for enforcing major securities laws. For instance, while the Securities and Exchange Act prohibits using insider or nonpublic information to make trades, the SEC can have its own rules on how it will investigate charges of insider trading. Like laws, regulations are codified and published so that parties are on notice regarding what is and is not legal. Regulations often have the same force as laws.
